Gegenstand der Untersuchung ist das Zusammenspiel von europäischem Beihilferecht und nationalem Steuerrecht unter besonderer Berücksichtigung von Tax Rulings. Der Autor legt dar, dass durch die großflächige Anwendung des Beihilferechts auf dem Gebiet des Steuerrechts das unionale Kompetenzgefüge zulasten der Mitgliedstaaten verschoben wird und plädiert dafür, dieses im Rahmen der Beihilfekontrolle stärker zu berücksichtigen. Dabei wird aufgezeigt, dass die Europäische Kommission derzeit bestrebt ist, das Beihilferecht zu originär steuerrechtlichen Zwecken – der Verhinderung von Gewinnverlagerungen und steuerfreier Unternehmensgewinne (sog. weiße Einkünfte) – einzusetzen, wozu dieses nach Ansicht des Autors jedoch weder konzipiert noch tatsächlich geeignet ist. Abschließend erfolgt eine Analyse zum Verhältnis des Beihilferechts zum schädlichen Steuerwettbewerb. Dabei wird auch auf die Frage eingegangen, ob das Beihilferecht einen Beitrag zur Bekämpfung unerwünschter Entwicklungen leisten kann.'The Influence of European State Aid Law on National Tax Benefits. Subject of the thesis is the interplay between European state aid law and national tax law with special focus on tax rulings. It is demonstrated that the use of state aid law for purely tax law purposes, the avoidance of profit shifting and tax-free company profits, is misguided. At the same time, this use of state aid law shifts the balance of competences in the Union to the detriment of the Member States.
